The Varna Administrative Court has suspended the planned demolition of 12 residential buildings in the Baba Alino area near Varna, ruling that the structures cannot be removed until the legal disputes over the case are resolved.
The decision came after two investor companies, Forest Club Varna OOD and Venedikt 02 OOD, challenged demolition orders issued by Varna Mayor Blagomir Kotsev. The companies have filed 12 administrative cases contesting the orders, which concern 12 multi-family residential buildings containing more than 40 apartments.
The court ruled that the municipality had failed to justify its decision to allow the demolition orders to be enforced before the completion of the court proceedings. According to the judges, the mayor’s administration did not provide sufficient reasoning or demonstrate the legal conditions required for such preliminary enforcement.
Because the municipality did not adequately explain why the buildings needed to be demolished before the courts reached a final decision, the court canceled the preliminary execution of the mayor’s orders. As a result, any demolition work must wait until the cases are decided on their merits.
The ruling means the legal battle could continue for an extended period. Similar disputes have often taken years to conclude, leaving the status of the affected properties unresolved while court proceedings continue.
The Administrative Court’s decisions are not final and may be appealed within seven days.
